There are two issues in this case. First, did the Court of Appeals err in considering the insufficiency of the evidence, when the issue was not raised in a motion for a new trial? Second, did the Court of Appeals err by finding there was insufficient evidence of force and coercion, an element of fourth-degree criminal sexual conduct? We hold that where a claim of insufficient evidence to support a verdict is not raised before the trial Judge, the claim may be raised on appeal without the necessity of filing a motion for a new trial.
