Order On order of the Court, the delayed application for leave to appeal is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND this case to the Oakland County Circuit Court for resentencing under the provisions of 1987 PA 275, as this Court earlier ordered. People v Koeppe, 437 Mich 866, 462 NW2d 588 (1990); People v Schultz, 435 Mich 517, 460 NW2d 505 (1990). When this case was remanded to the trial court by this Court in 1990, the trial Judge only determined whether there were substantial and compelling reasons to depart from the minimum term of imprisonment of 20 years. On remand, the trial Judge shall resentence the defendant to a term of imprisonment based on the provisions of 1987 PA 275 which provides for a mandatory minimum term of imprisonment of 10 years. We do not retain jurisdiction.
