The motions for leave to file briefs amicus curiae also are considered, and they are GRANTED. The delayed application for leave to appeal is considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND the case to the Court of Appeals for reconsideration in light of Department of Social Services v Emmanuel Baptist Church, 434 Mich 380 (1990), and decisions of the United States Supreme Court since the issuance of the Court of Appeals decision in this case.
