A jury found defendant guilty of three counts of rape, (Pen. Code, § 261, subd. 4), one count of committing an infamous crime, (Pen. Code, § 286), two counts of participating in acts of oral copulation, (Pen. Code, § 288a), and two counts of kidnaping, (Pen. Code, § 207), as charged in the information. The jury found defendant not guilty of one count of committing an infamous crime against nature. Two prior felony convictions were also charged. Defendant admitted one prior; an objection to the proof of the second conviction was sustained. After conviction, the trial judge sentenced defendant to the state prison, the sentences to run concurrently with one another and consecutively with a sentence defendant was then serving. Defendant appeals from the judgment of conviction.
