Order On order of the Court, the delayed application for leave to appeal is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND this case to the trial court. On remand, the trial court shall determine whether the defendant was denied the effective assistance of counsel during the hearing on the defendant's motion to suppress his confession. People v Ginther, 390 Mich 436 (1973). If the trial court determines that the defendant was denied the effective assistance of counsel during that phase of the proceedings in this case, the trial court shall reopen the evidentiary hearing to determine whether the defendant's confession was voluntary. People v Walker (On Rehearing), 374 Mich 331 (1965). We do not retain jurisdiction.
