ORDER On order of the Court, the application for leave to appeal is considered and, pursuant to MCR 7.302(F) (1), in lieu of granting leave to appeal, we VACATE the Court of Appeals judgment of March 13, 1995, and REMAND the case to the Court of Appeals for consideration of whether the defendant met the ""cause and prejudice"" standard of MCR 6.508(D) (3). The application for leave to appeal as cross-appellant also is considered, and it is DENIED.
